The Intersoft Group, Inc., hereafter known as Intersoft, will provide Internet hosting services for the Account Holder listed above. Services will be for the domain name entered above only and will begin on the above date.

Terms and Conditions

The undersigned Account Holder agrees to abide by the following terms and conditions of this service contract. Violations of any terms and/or conditions of this agreement may result in termination of service

1. Payment for services is due in advance. Intersoft may charge a reasonable late charge for any past due payment. Intersoft may suspend services if payment is not received as agreed. A reconnect charge will be imposed to restore service. The Internet account and related electronic services can only be used for legal purposes under all international, federal, state and local laws.
2. Intersoft does not host Adult sites. Account Holder agrees not to store, transmit, link to, advertise or make available any images containing nudity or semi-nudity. Intersoft has the right to refuse service if content of information provided is deemed illegal, misleading, or obscene. Intersoft will make the final determination in any dispute over unacceptable content and Account Holder agrees to accept Intersoft's decision. The Account Holder agrees to follow generally accepted "Netiquette" when sending email messages or posting newsgroup messages.
3. Hosting fees and other fees are subject to change at any time. If this service is paid on a monthly basis, it will be subject to future price increases.
4. Account Holder is responsible for the security of their password. Intersoft will not change passwords to any account without verification of identity which is satisfactory to Intersoft, such verification may include written requests with signature.
5. In the event of any dispute of ownership, Account Holder understands Intersoft will remain neutral and may put the account on hold until the situation has been resolved. Under no circumstances will Intersoft be liable for any losses incurred by Account Holder.
6. The Account Holder agrees not to harm Intersoft, its reputation, computer systems, software and/or other Account holders using Intersoft's services or the service of any of Intersoft's contractors.
7. Intersoft reserves the right to select the computer for Account Holder's web site for best performance. Intersoft may use third party contractors to fulfill it's obligations to Account Holder.
8. Account Holder may have to agree to additional provisions from Intersoft covering this agreement and/or any future services added to this agreement. If Account Holder refuses to accept any future provisions, Account holder will have the option to cancel service and receive a pro-rated refund of any moneys pre-paid for this agreement. The pro-rated refund will be calculated after the normal monthly cost for the service has been deducted from any amounts pre-paid by Account Holder.
9. Account Holder understands this service is provided on a shared server. This means that one web site cannot overwhelm the server with heavy CPU usage from highly active CGI scripts or chat scripts. If your web site overwhelms the server and causes complaints from the other users, you will have outgrown the realm of a shared server and you will need to re-locate your web site. Intersoft will refund any moneys paid for unused time of service remaining.
10. Except as stated above, all moneys paid under this agreement are not refundable.
11. If Account Holder breaches this agreement, Intersoft has the right to terminate service without any refunds of the unused portion prepaid by Account Holder. The Account Holder agrees to indemnify and hold harmless both Intersoft and other Account Holders from any and all claims and/or costs resulting from the Account holder's use or abuse or the service in any manner. In the event Intersoft has to engage the services of an attorney, then Account Holder will pay any and all Intersoft's reasonable attorney fees and court costs. The Account Holder's rights and privileges cannot be sold or transferred without the written consent and approval from Intersoft in advance.
12. Intersoft will use its best efforts to maintain a full time, 24 hour Internet presence for Account Holder. Account Holder understands and agrees that network and equipment failures can interrupt Account Holder's Internet presence and Account Holder will hold Intersoft, it's employees, owners, officers, and contractors free and harmless from any loss resulting from any reason whatsoever. Intersoft's total liability under any and all circumstances will never exceed the amount paid by Account Holder for the duration of this agreement.

This agreement represents the complete understanding between the parties. The undersigned Account Holder agrees to fully abide by all said terms and conditions stated above.
